PRIMETHIC – CONNECT EC: TERMS & CONDITIONS

By accessing, registering on, or using Connect EC, including its mobile applications, websites, hiring alignment tools, assessments, reports, and related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms").

These Terms constitute a legally binding agreement between you and PRIMETHIC, the owner and operator of Connect EC.

1. Definitions

"PRIMETHIC" means the company that owns and operates Connect EC and related products and services.

"Assessment Outputs" means alignment assessments, alignment reports, predictive indicators, engagement indicators, recommendations, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, workflow suggestions, and other informational outputs generated by the Platform.

For the purposes of these Terms, “Platform” refers to the Connect EC mobile application, website, systems, and services. “Employer” means any organization or authorized representative using the Platform to post jobs and engage Recruiters or Candidates. “Recruiter” refers to a person authorized by an Employer to conduct hiring-related activities. “Candidate” means an individual using the Platform to seek employment or interact with Employers or Recruiters. “User” means any person who accesses or uses the Platform. “Content” includes all data, information, messages, documents, images, videos, and materials uploaded or shared through the Platform.

2. Nature of Service

Connect EC is a technology-enabled facilitation platform that connects Employers, Recruiters, and Candidates. Connect EC does not guarantee employment, independently verify all information provided by users, act as an agent or representative, or participate in employment contracts or commercial arrangements between Users. All hiring decisions are solely the responsibility of the Users involved.

Connect EC may generate assessments, reports, predictive indicators, engagement signals, recommendations, scheduling indicators, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, and other informational outputs designed to support hiring visibility, coordination, and decision-making.

Such outputs are informational tools only and do not constitute employment decisions, legal advice, professional advice, guarantees of outcomes, or representations regarding any Candidate, Recruiter, Employer, or hiring decision.

3. User Eligibility and Representations

By using the Platform, Users represent that they are at least eighteen years of age, that all information provided is accurate and complete, and that they will comply with applicable laws. Users agree not to impersonate others, misuse the Platform, or engage in illegal or harmful activities. Any false representation may result in suspension, termination, or legal action.

4. Registration and Account Security

Users may be required to register using valid contact details. Users are solely responsible for maintaining the confidentiality of their login credentials and for all activities conducted through their accounts. Connect EC reserves the right to modify or remove accounts or usernames that are inappropriate or violate these Terms.

4A. User Communications

By registering for or using the Platform, Users acknowledge that PRIMETHIC may communicate with them through email, SMS, telephone, in-app notifications, push notifications, WhatsApp, or other electronic communication channels in connection with the operation and use of the Platform.

Such communications may include, without limitation:

• account verification and authentication;

• password resets and security alerts;

• interview scheduling notifications;

• hiring workflow updates;

• assessment results and Platform outputs;

• system maintenance notices;

• policy updates;

• important service announcements;

• account administration and support communications.

Where a User has separately provided consent or where otherwise permitted by applicable law, PRIMETHIC may also communicate information relating to:

• new Platform features;

• product enhancements;

• additional services;

• educational resources;

• newsletters;

• surveys;

• research initiatives;

• promotional campaigns;

• events; and

• other products or services offered by PRIMETHIC.

Users may withdraw consent for promotional communications at any time using the unsubscribe mechanism provided or by updating their communication preferences where available. Withdrawal of such consent shall not affect communications that are necessary for providing the Platform, protecting user accounts, complying with legal obligations, or maintaining Platform security.

5. User Responsibilities and Conduct

All Users shall use the Platform in a lawful, ethical, and professional manner.

Employers are responsible for posting genuine job opportunities, providing accurate information, managing Recruiters under their accounts, and ensuring compliance with applicable laws. All actions taken by Recruiters shall be deemed actions of the Employer. Employers are solely responsible for interviews, feedback, and all content uploaded through their accounts.

Recruiters shall communicate professionally, provide accurate information, respect Candidate privacy, and maintain integrity in hiring processes.

Candidates shall provide accurate information, behave professionally, and engage honestly with Employers and Recruiters.

Users remain solely responsible for evaluating information, recommendations, reports, indicators, and other outputs generated by the Platform before making employment, recruitment, or hiring decisions.

6. Prohibited Activities

Users shall not engage in unauthorized access, reverse engineering, data scraping, malware distribution, impersonation, harassment, submission of false information, or any activity that is illegal or harmful. Users shall not misuse Platform content for competing commercial purposes.

7. User-Generated Content and Communications

The Platform provides in-app communication features. Connect EC does not actively monitor communications but may access content for compliance, safety, or legal purposes. Users are solely responsible for their content.

By submitting content, Users grant PRIMETHIC a worldwide, royalty-free, non-exclusive license to host, process, display, reproduce, and use such content solely for operating, maintaining, improving, securing, and providing the Platform.

8. EC Scores, Alignment Scores, Status, and Recognition

The Platform may generate EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, participation indicators, recognition features, and other alignment-related outputs based on user participation, engagement, responsiveness, decision-making, and alignment-related activities.

Such scores, status indicators, rankings, recognitions, and informational outputs are indicative only and do not create any legal rights, obligations, employment rights, contractual rights, or entitlements.

8A. Assessments, Reports, and Platform Outputs

Connect EC may generate alignment assessments, alignment reports, predictive indicators, engagement signals, recommendations, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, workflow suggestions, and other informational outputs.

These outputs are intended to support user awareness, visibility, coordination, and decision-making.

PRIMETHIC does not guarantee the accuracy, completeness, suitability, future performance, employment outcomes, recruitment outcomes, hiring outcomes, or business outcomes associated with any Platform output.

Users remain solely responsible for decisions made based on such outputs.

9. License to Use Platform

Users are granted a limited, revocable, non-exclusive, and non-transferable license to use the Platform in accordance with these Terms.

10. Third-Party Services

The Platform may integrate third-party services. Connect EC is not responsible for the policies or practices of third-party providers.

11. Enforcement and Safety

PRIMETHIC reserves the right to suspend or terminate accounts for violations of these Terms, fraudulent conduct, or legal non-compliance. PRIMETHIC may cooperate with law enforcement authorities as required by law.

12. Termination

Users may discontinue use of the Platform at any time. PRIMETHIC may suspend or terminate access without prior notice for violation of these Terms. Upon termination, user access shall cease immediately.

12.A No Employment Relationship

Use of the Platform does not create any employment, agency, partnership, joint venture, fiduciary, recruiter-client, employer-employee, or representative relationship between PRIMETHIC and any User.

13. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, PRIMETHIC shall not be liable for employment outcomes, hiring outcomes, recruitment outcomes, business outcomes, user decisions, platform recommendations, predictive indicators, assessment outputs, engagement signals, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, user-generated content, service interruptions, or any indirect, incidental, consequential, or special damages arising from the use of the Platform.

14. Dispute Resolution

All disputes shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Chennai, India, the language shall be English, and the arbitration shall be conducted by a sole arbitrator. Courts at Chennai shall have jurisdiction for interim relief and enforcement.

15. Governing Law

These Terms shall be governed by the laws of India.

16. Privacy Policy

Use of the Platform is subject to the Privacy Policy, which forms an integral part of these Terms.

17. Changes to Terms

PRIMETHIC may modify these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.

18. Intellectual Property Rights

All content, materials, and works available on or through the Connect EC platform, including but not limited to software, documentation, workflows, user interfaces, text, graphics, icons, status indicators, scores, rankings, and visual elements, are the exclusive property of PRIMETHIC or its licensors and are protected under the Copyright Act, 1957, trademark laws, and other applicable intellectual property laws.

The platform name Connect EC, together with associated EC Score systems, Alignment Score systems, Alignment Status identifiers, Alignment Board systems and identifiers, and related proprietary marks, names, symbols, and identifiers, are owned by PRIMETHIC and protected under applicable intellectual property laws.

The Connect EC alignment architecture, hiring workflows, timer-driven action framework, assessment structures, EC Score systems, Alignment Score systems, Alignment Status systems, Alignment Board systems, reports, and related implementations, including their documented structure, sequencing, scoring logic, timer mechanisms, and expressive implementations, are protected under applicable copyright, trademark, trade secret, and other intellectual property laws.

Except as expressly permitted under these Terms, no part of the Platform or its content may be copied, reproduced, modified, distributed, displayed, transmitted, or exploited in any form without the prior written consent of PRIMETHIC.

1. Introduction

PRIMETHIC ("Company", "we", "our", or "us") owns and operates Connect EC, including its mobile applications, websites, hiring alignment tools, assessments, reports, and related services (collectively, the "Platform").

This Privacy Policy explains how PRIMETHIC collects, uses, stores, discloses, and protects personal data in accordance with the Digital Personal Data Protection Act, 2023 (India) and other applicable data protection laws.

By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to this Privacy Policy. If you do not agree, you must discontinue use of the Platform.

2. About Connect EC

Connect EC is a hiring alignment platform developed and operated by PRIMETHIC.

Connect EC helps Candidates, Recruiters, and Employers improve hiring decisions through alignment assessments, hiring workflows, visibility tools, engagement insights, predictive indicators, scheduling systems, and hiring coordination features.

Connect EC may provide hiring-related analytics, alignment assessments, alignment reports, predictive indicators, engagement signals, and workflow recommendations intended to improve hiring visibility, coordination, and decision-making. These insights are intended to support users and should not be treated as the sole basis for employment or hiring decisions.

To operate efficiently and improve service quality, PRIMETHIC processes personal data through Connect EC and related services in accordance with global privacy principles, the Digital Personal Data Protection Act, 2023, and other applicable regulations. This Privacy Policy applies to all users worldwide.

PRIMETHIC may develop additional products, services, assessments, analytics, reports, and alignment systems that operate under the same privacy principles described in this Privacy Policy.

This Privacy Policy applies to Connect EC and other services operated by PRIMETHIC unless a separate privacy policy is expressly provided.

3. Information We Collect

We collect personal information that you voluntarily provide when registering or using the Platform, including your name, phone number, email address, resume details, education, work experience, skills, profile photographs, uploaded documents, employer or recruiter identification details, job preferences, application history, and identity verification information where required. This information enables us to provide hiring and recruitment services effectively.

4. Behavioural and Usage Information

To enhance platform performance and hiring outcomes, we collect behavioural and activity-related data such as interview scheduling activity, feedback exchanged between users, engagement levels, EC Scores, Alignment Scores, Alignment Status, Alignment Board participation and rankings, clickstream data, navigation patterns, time spent on the Platform, and hiring funnel progression.

Behavioural and usage information may also include responses provided during alignment assessments, hiring scenarios, platform interactions, communication patterns, scheduling activity, engagement signals, and workflow participation.

Such information may be used to generate EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, alignment insights, hiring visibility indicators, engagement trends, and predictive signals designed to improve hiring coordination and user experience.

5. Device and Technical Information

We automatically collect certain technical and device-related information, including device model, operating system version, unique device identifiers, IP address, approximate location, browser information (for website users), crash reports, diagnostics data, system logs, and network performance metrics. This data is used to maintain platform security, stability, and performance.

6. App Permissions

Subject to your explicit consent, the Platform may request optional permissions such as access to your camera for profile images, storage for uploading resumes or documents, microphone for voice-based features, location for relevant job suggestions and fraud prevention, contacts for referrals, and social accounts for login or profile import. Denial of optional permissions may restrict certain features, but will not prevent basic access to the Platform.

7. How We Use Your Information

We use personal data strictly for legitimate and lawful purposes, including matching candidates with suitable job opportunities, enabling employers and recruiters to identify relevant talent, improving interview scheduling efficiency, providing hiring insights and predictive indicators, enabling in-app communication and notifications, personalizing user experience, improving platform performance, preventing fraud and misuse, securing the Platform, and complying with legal obligations. We do not sell personal data to advertisers or unrelated third parties. We do not use personal data for unrelated advertising purposes.

7A. Alignment Assessments, Reports, and Automated Insights

PRIMETHIC processes personal data through Connect EC and related services. Connect EC may generate alignment assessments, alignment reports, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, engagement indicators, predictive insights, workflow recommendations, scheduling indicators, and hiring visibility signals using information provided by users and platform activity.

These outputs are intended to assist decision-making and improve hiring visibility and coordination. They should not be treated as guarantees, employment decisions, legal advice, professional advice, or the sole basis for hiring decisions.

Users remain responsible for their own recruitment, employment, and hiring decisions. Alignment assessments, predictive indicators, engagement signals, and recommendations are designed to support hiring workflows and platform coordination. They do not determine employment eligibility, suitability, selection, promotion, compensation, or other employment decisions.

7B. Communications, Product Updates, and User Engagement

PRIMETHIC may use the contact information you provide, including your email address, mobile number, and other communication preferences, to communicate with you regarding the operation, improvement, and enhancement of the Platform.

Such communications may include:

• account verification and security notifications;

• password reset and authentication messages;

• hiring workflow updates and activity notifications;

• interview scheduling reminders and status updates;

• assessment results, reports, recommendations, and platform-generated insights;

• announcements relating to new features, services, products, or functionality;

• educational resources, knowledge articles, research publications, and best practices;

• invitations to webinars, events, user studies, surveys, beta programs, and product feedback initiatives;

• newsletters, platform announcements, and promotional communications relating to Connect EC and other products or services offered by PRIMETHIC.

Where required under applicable law, promotional or marketing communications will be sent only with your consent or another lawful basis for processing. You may withdraw your consent or unsubscribe from such communications at any time through the unsubscribe mechanism provided in the communication, your account settings (where available), or by contacting us using the details provided in this Privacy Policy.

Withdrawal of consent for promotional communications will not affect communications that are reasonably necessary for account administration, security, fraud prevention, legal compliance, or the continued provision of the Platform.

8. Legal Basis for Processing

Personal data is processed based on lawful grounds, including your freely given consent, purpose-based processing necessary for providing Platform services, and compliance with applicable legal obligations. You may withdraw your consent at any time through app settings or by contacting us via email. Withdrawal of consent will not affect the lawfulness of processing carried out prior to such withdrawal.

9. Sharing of Information

PRIMETHIC does not sell personal data, behavioural data, alignment assessment results, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, engagement indicators, predictive insights, or user-generated hiring information to unrelated third parties for commercial purposes.

Personal data may be shared with Employers and Recruiters when a Candidate applies for a role, expresses interest, or participates in hiring workflows. Shared data may include profile information, job-related activity, hiring journey status, and other information necessary to facilitate hiring coordination and decision-making.

We may also share data with trusted third-party service providers, including analytics providers, hosting providers, communication service providers, authentication providers, and security partners, who act as Data Processors and are contractually obligated to process personal data only in accordance with our instructions and applicable laws.

9A. Platform Visibility and Recognition Features

Connect EC includes participation, recognition, alignment, and hiring coordination features that may display certain user information, EC Scores, Alignment Scores, Alignment Status, Alignment Board rankings, participation indicators, hiring signals, and related Platform outputs to authorized users within the Connect EC ecosystem, subject to the user's role, permissions, and participation within the Platform.

Such visibility and recognition features are intended operational functions of the Platform designed to support alignment, coordination, transparency, trust, engagement, and hiring decision-making across Candidates, Recruiters, and Employers.

10. Legal and Business Disclosures

We may disclose personal data where required by law, regulation, court order, or government authority, or as part of compliance investigations. In the event of a merger, acquisition, restructuring, or asset transfer, personal data may be transferred as part of the transaction, subject to appropriate safeguards.

11. Children’s Privacy

The Platform is not intended for individuals below eighteen (18) years of age. We do not knowingly collect personal data from minors. If a minor account is identified, it will be deleted promptly.

12. Data Security

We implement industry-standard technical and organisational security measures, including encryption of data in transit and at rest, secure servers, access controls, monitoring, and regular audits. While we take reasonable steps to protect personal data, no system is completely secure, and users acknowledge the inherent risks of online platforms.

13. Data Retention

Personal data is retained only for as long as necessary to provide services, comply with legal obligations, detect fraud, resolve disputes, and enforce agreements. Upon receipt of a valid deletion request, personal data will be deleted or anonymised, except where retention is required by law or regulatory obligations.

14. Your Rights

Subject to applicable law, you may have the right to:

• access your personal data;

• request correction of inaccurate or incomplete personal data;

• request deletion or anonymisation of personal data;

• withdraw previously granted consent where processing is based on consent;

• manage your communication preferences;

• opt out of newsletters, promotional communications, and marketing communications;

• request information regarding how your personal data is processed;

• nominate another individual to exercise applicable rights on your behalf in accordance with the Digital Personal Data Protection Act, 2023.

15. Cross-Border Data Transfers

In the event of a personal data breach that poses a risk to users, PRIMETHIC will notify affected individuals and relevant regulatory authorities, including India’s Data Protection Board where applicable, in accordance with legal requirements.

17. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect feature enhancements, security updates, or legal developments. Material changes will be communicated through in-app notifications or email. Continued use of the Platform after such updates constitutes acceptance of the revised Privacy Policy.
